Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers via the PeakMotion Fitness online shop ( www.peakmotionfitness.de ) within Germany.
A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity (Section 13 of the German Civil Code).

3. Conclusion of contract
The presentation in the online shop is not an offer, but merely an invitation to place an order.
The contract is concluded when you complete the ordering process and submit an order by clicking on the order button.
Immediately thereafter, you will receive an automatically generated order confirmation by email. This represents acceptance of your offer.
4. Contract language & storage of the contract text
The contract language is German .
We do not save the contract text. You can print or save the order details immediately after submitting your order.
5. Correction of input errors
Before submitting your order, you have the opportunity to review and correct your entries at any time. To do so, use the buttons provided during the ordering process or your browser's back function.
6. Products & Shipping Details
Our products are delivered directly from our warehouse in Germany.
All orders are usually processed and shipped within 1-2 business days after receipt of payment.
The delivery time within Germany is usually 2-4 working days , but may vary in exceptional cases (e.g. due to public holidays, shipping service providers).
After shipping, you will receive a tracking number to track your delivery.
7. Prices & Shipping Costs
All prices quoted are final prices plus shipping costs.
Due to our small business status according to Section 19 of the German Value Added Tax Act (UStG), we do not charge or report sales tax.
Shipping costs within Germany: 4.99 €
Delivery is free of charge for orders over €60.00 .
8. Payment methods

Your account will be debited immediately after the order process is completed, unless otherwise stated for the respective payment method.
9. Right of withdrawal
Cancellation policy
You have the right to withdraw from this contract within 14 days without giving any reason.
The period begins on the day on which you or a third party designated by you received the goods.
To exercise your right of withdrawal, you can use our withdrawal form or send your withdrawal to us in any form (e.g. by email).
You can find the form on our website under the menu item “Cancellation”.
Please complete the form completely and submit it before making a return.
Consequences of revocation
In the event of cancellation, we will refund all payments we have received from you, including delivery costs (excluding additional costs due to a different delivery method).
The refund will be made within 14 days from the day on which we receive notification of your cancellation.
The return costs are to be borne by the buyer unless otherwise agreed in writing.
10. Return of goods
In case of cancellation or return, the goods must be sent to the following address:

Please note that returns can only be processed to this address. Returns without postage paid or to other addresses will not be accepted.
The return costs are to be borne by the buyer unless otherwise agreed in writing.
The return shipment must be made at your own risk using a parcel service of your choice.
Please ensure that you ensure sufficient postage is paid for the return shipment and select insured shipping with tracking .
We recommend that you provide a tracking number so that we can track the return.
Returns without postage paid or which cannot be tracked will not be accepted.
11. Warranty
The statutory warranty rights apply.

12. Retention of title
The goods remain our property until full payment has been made.
13. Liability
We are fully liable for damages caused intentionally or by gross negligence.
In the case of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), but limited to foreseeable, contract-typical damage.
Any further liability is excluded.
14. Online Dispute Resolution & Consumer Dispute Resolution
The EU Commission provides a platform for online dispute resolution:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Applicable law
The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
16. Discount promotions and vouchers
Discount promotions and voucher codes cannot be combined unless otherwise stated. Only one discount will be granted at a time—usually the highest available discount.
Discounts are only valid within the specified period and cannot be applied retroactively.
